Booking Terms and Conditions

Introduction

Please read the following terms and conditions carefully.  You must not make any booking unless you understand and agree with the following terms and conditions. References to “us”, “we” and/or “our” in these booking terms and conditions shall mean Blazenka’s Travel Pty Ltd.  Where bookings of travel products are made on your behalf through Adriatic Adventures or Experience Croatia, references to “us”, “we”, and/or “our” in these booking terms and conditions shall also mean and include Blazenka’s Travel Pty Ltd trading as Adriatic Adventures and Experience Croatia.

These terms and conditions apply to bookings you make with our consultants (in-store, over phone or by email) as well as online bookings you make on our website.

We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions.

Blazenka’s Travel Pty Ltd trading as Adriatic Adventures is an ATAS accredited Travel Agent and a member of AFTA, Blazenka’s Travel Pty Ltd trading as Experience Croatia is also an ATAS accredited Travel Agent and a member of AFTA & CATO.

We provide you with Booking & Advisory Services that allow you to acquire a Travel Product from a Third Party Travel Provider. We act as agent for the Third Party Travel Provider.

By acquiring Booking & Advisory Services from us, you agree that you have read and accept both these terms and conditions and the terms and conditions of the Third Party Travel Provider relating to the Travel Product.

You pay us for providing the Booking & Advisory Services to you.

It is solely your responsibility to make yourself aware of the terms and conditions set out by the Third Party Travel Provider.

Executive Summary of Key Terms and Conditions:

  • We are solely responsible for Booking & Advisory Services
  • We charge change fees and cancellation fees for our services.
  • A Refund might be provided once we have deducted Third Party Providers cancellations fees and our Service fees.

Disclosure of fees or commissions received from third parties:

We may receive commissions or financial incentives from third parties under this contract.

Prices:

  • Prices are quoted in Australian Dollars
  • Prices are subject to change at the discretion of the supplier, prior to booking. This is beyond our control.
  • Price may changed or fluctuate with due to the exchange rate (foreign currencies)
  • Prices may include applicable taxes, some taxes may be additional and payable upon arrival.
  • Generally, price is only guaranteed once paid for in full

Service guarantees:

Our booking and advisory services come with a guarantee under the Australian Consumer Law that:

they will be provided with due care and skill;

  • they will be reasonably fit for the specified purpose;
  • they can reasonably be expected to achieve the desired result; and
  • they will be provided within a reasonable time.
  • We agent cannot guarantee the performance of the suppliers
  • Bookings are subject to the Third Party Provider Terms & Conditions including conditions of carriage and limits on liability.
  • Customer is responsible for reading these before finalising transaction.

If we fail to meet any of these guarantees, you have rights under the Australian Consumer Law.

Travel Agent’s fees:

In most cases we do not charge fees over and above your product cost, (if a fee will be charged you will be advised in advanced of payment) but in case of cancellation and refunds we do reserve the right to withhold commissions plus a service fee associated with time spend on your booking as this covers, office running costs etc. Please refer to Our Change and Cancellation Fees set out in these Terms and Conditions.

Names Provided for Documentation:

Please check the spelling of all names, that they are correct as per passport prior to payment and documentation. While we have taken great care to check your travel documents, it is important that you review all of the information in the documents including but not limited to, your name, travel dates and other particulars relating to your travel arrangements. Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Failure to check your documents and or there being errors in spelling once documentation has been processed will incur change fees and service fees and you may be turned away from your travel service.

Travel Insurance:

Without travel insurance you and/or your family are personally liable for covering any medical and associated costs you may incur while travelling. We strongly recommend you take out a full coverage travel insurance policy at the time you pay for your booking. All of our consultants are FSR compliant and can recommend a policy to suit your needs. It is your responsibility to read and fully understand the Product Disclosure Statement of your insurer.

Disclosure Authorisation:

In the event that a natural disaster or other emergency is reported to have occurred in a country where you may be visiting at that time, you authorise Blazenka’s Travel to disclose the details of your itinerary and contact details to the Australian Department of Foreign Affairs and Trade.

Passports and Visa Requirements:

All travellers must have a valid passport with at least 6 months validity beyond the period of intended stay. Some countries require a longer validity. Permanent residents travelling on a foreign passport must hold a Resident Return Visa to re-enter Australia. We recommend that you check the entry requirements of the countries you plan to visit or transit, including all visa requirements, with the relevant foreign embassy or consulate.

Health Requirements and Vaccinations:

Some countries require you to be vaccinated against specific infection and/or diseases. We recommend that you consult with your doctor or specialist vaccination clinic before commencing your travel. General health advice for the destination you wish to visit is also available at the Department of Foreign Affairs and Trade website: www.smarttraveller.gov.au.

Our Change and Cancellation Fees:

Subject to your refund and remedy rights under the Australian Consumer Law, the following change and cancellation fees apply to all bookings (including online bookings and bookings made with a consultant):

Airfare Changes and Cancellation 

Each fare within the itinerary you have booked carries unique rules and restrictions:

  1. If each fare has an airline change fee, then the highest fee applies to each traveller.
  2. If any fare does not allow changes, then no changes are allowed to any flight.
  • If any fare is non-refundable, then all flights are non-refundable for International flights excluding Trans-Tasman.

Please refer to the “Penalties” portion of each fare for all rules. These can be found in the Fare Rules section of your flight summary. The total cost of your change with us will depend on the following:

  • airline change fee, possible fare and tax difference and Blazenka’s Travel applicable fee’s as per below
  • Changes to Domestic/Trans-Tasman bookings will incur a fee of $30 per passenger per booking in addition to supplier fees.
  • Changes to International bookings (excluding Trans-Tasman bookings) will incur a fee of $50 per passenger per booking in addition to supplier fees.
  • Cancellations to Domestic/Trans-Tasman bookings will incur a fee of $75 per passenger per booking in addition to supplier fees.
  • Cancellations to International bookings (excluding Trans-Tasman bookings) will incur a fee of $200 per passenger per booking in addition to supplier fees.
  • For international and cruise bookings only: will incur a fee of $200 per passenger per booking in addition to supplier fees, transaction fees and exchange rate differences.
  • If customers choose to keep the full amount of their booking on file for future travel, we will waive the Adriatic Adventures cancellation fees.  Please note that supplier cancellation fees may apply.

Land Arrangements and Cruises Changes and Cancellation 

(a) Bookings cancelled at any time after confirmation are subject to the forfeit of the security deposit as above, and refunds will follow the below scale 1)c) we may refund to you any amounts we have not yet sent or legally have committed to send to suppliers less our administration costs.

(b) In addition to this fee are any charges made by the hotel, tour operator, cruise line or other principal. This can amount to up to 100% of total land arrangement costs, particularly when cancelling tours and other arrangements within 60 days of departure. Some provider cancellation charges may also incur VAT. You should check what additional cancellation fees apply (if any) BEFORE paying your deposit.

CANCELATION CHARGES ON LAND ARRANGEMENTS
From time of confirmation to 30 days prior to the commencement of the first day of your booking the full security deposit is non-refundable + any non-refundable segments to suppliers (clients will be informed if they are being offered a non-refundable segment)
29 – 22 days the security deposit + 25% of the total balance amount is non-refundable + any non-refundable segments to suppliers + transaction fees and exchange rate differences (clients will be informed if they are being offered a non-refundable segment)
21 – 15 days the security deposit + 45% of the total balance amount is non-refundable + any non-refundable segments to suppliers + transaction fees and exchange rate differences (clients will be informed if they are being offered a non-refundable segment)
14 – 0 days & no show = 100% of total trip (security deposit and balance is non-refundable)+ any non-refundable segments to suppliers + transaction fees and exchange rate differences (clients will be informed if they are being offered a non-refundable segment)

CANCELATION CHARGES ON CRUISES
From time of confirmation to 46 + days prior to the commencement of the first day of your cruise the full security deposit is non-refundable
45 – 0 days 100% of the cruise is non-refundable

Amendment Charges

(1) No Experience Croatia & More fee applies for the first amendment or to extend an existing booking before documentation is issued, dependent upon supplier policy. Please check with us first.

(2) Second and subsequent amendments, excluding extensions or additions after confirmations, will incur a $30 fee per booking and per sector or segment.

(3) After documentation (vouchers) are issued a $30 fee will be charged for any changes.

We highly recommend that you obtain Travel Insurance to cover yourself in the event of a cancellation.

Supplier Change and Cancellation Fees:

Cancelled bookings may also incur supplier fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced.  Supplier fees may also apply where a booking is changed and when tickets or documents are re-issued. Where we incur any liability for a supplier cancellation fee for any booking which you change or cancel, you agree to indemnify us for the amount of that fee.  Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from the supplier, refund amounts will be minus supplier fees, transaction fees, exchange rate differences and admin fees (which may take up to 12 weeks dependent upon the supplier processing time).

Deposit and Final Payment:

You will be required to pay a deposit or deposits when booking. Your consultant will advise you of how much that will be. All deposits are non-refundable for changes of mind or cancellations by you (subject to your rights under the Australian Consumer Law).  Final payment is required no later than 6o days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking. Final balance for certain products is required at least 90 days before departure. This will be advised of the final payment date at the time your booking is made. Late payment may lead to cancellation and/or late documentation. No documentation or travel vouchers will be issued until payment is received in full.

Payments by Credit Card and Debit Card:

Credit card surcharges of 1.8% for Visa, 1.8% for MasterCard, 2% for American Express, will apply when paying by credit card.

Debit card surcharges of 0.50% for debit card Visa and 0.50% for debit card MasterCard will apply when paying by debit card.

You authorise us to charge all fees incurred by you in relation to the services provided to the credit card or debit card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due immediately on demand.

If you choose to save your credit card details with us they will be securely stored and may be used for your future transactions with us (including transactions agreed over the phone or by email). You can choose to remove your saved credit card details at any time.

Cash Payment Limit: Due to Federal legislation from 1 January 2020 we are unable to accept cash payments of $10,000 or more per booking; this includes multiple payments for the same booking which total $10,000 or more.  Cash payments of less than $10,000 per booking can be accepted; this includes multiple payments for the same booking which total less than $10,000.

Taxes:

Airline taxes are subject to change and are confirmed at the time your airline ticket is issued. There may also be a local tax charged at some airports.

REFUNDS:

Refunds

No refund is available for cancellations after travel has commenced or in respect of any tours, accommodation, meals or any other services not utilised. Any valid refund payable will be made nett of any applicable fees and charges, including but not limited to merchant transaction fees and cancellation charges (as above) levied by either Experience Croatia & More or third parties.

Refunds for Travel Products are subject to the terms and conditions that you agreed with the Third Party Travel Provider.  If the Third Party Travel Provider is required to provide you with a refund for the Travel Product, we will provide you with a refund ONCE WE HAVE BEEN RE-IMBURSED BY THE THIRD PARTY TRAVEL PROVIDER, subject to these terms and conditions including the application of any cancellation fees. (Cancellation Fees are made up of supplier fees, transaction fees, exchange rate differences and admin fees (which may take up to 12 weeks dependent upon the supplier processing time).

Where refunds for unused services are allowed, a service fee may be charged by the Third Party Travel Provider against the value of the refund.  Please ensure that, when requesting a refund, you enclose copies of all relevant documentation. Please note that most airlines can take 60 – 90 days to process any refund.

NO SHOW

If you have a booking for a Travel Product, (including flights and accommodation) but you do not show up to check-in or otherwise do not avail yourself of such Travel Product, you will not be entitled to any refund from us.

Liability:

Because we provide you with Booking & Advisory Services and you pay us for acquiring Booking & Advisory Services, we are liable to you in accordance with these terms and conditions for breaching our obligations in providing the Booking & Advisory Services to you.

We act as an agent for, and sell various travel related products as agent on behalf of, numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators, as well as all of our wholesalers. Any services we provide to you are collateral to that agency relationship. Our obligation to you is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We exercise care in the selection of reputable service providers, and have no control over, or liability for, the services provided by third parties. All bookings are made on your behalf subject to the terms and conditions, including conditions of carriage and limitations of liability, imposed by these service providers.  We can provide you with copies of the relevant service provider terms and conditions on request.  Your legal rights in connection with the provision of travel services are against the specific provider and, except to the extent a problem is caused by fault on our part, are not against us.  Specifically, if for any reason (excluding fault on our part) any travel service provider is unable to provide the services for which you have contracted, your rights are against that provider and not against us.

Subject to the application of consumer guarantees which may be implied into the supply of Booking & Advisory Services to you, we are not otherwise liable to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including specific, direct, indirect, consequential, economic loss, incidental damages, lost profits or savings or damages for disappointment) which is suffered directly or indirectly in connection with the: the delivery or non-delivery of the Travel Product by the Third Party / Travel Service Provider; or any act or omission of Third Party Travel Providers or other third parties.

Nothing in these terms and conditions is intended to exclude or restrict the application of consumer guarantees under consumer protection laws but we do not give any guarantee or warranty and do not make any representation of any kind, express or implied, with respect to use of this Website or the Booking & Advisory Services supplied by us outside these laws.

To the extent permitted by law, neither Blazenka’s Travel Pty Ltd nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.  Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law).  This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).

Force Majeure:

Neither Party will be liable for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, outbreaks of infectious disease or any other public health crisis, civil commotion, breakdown of communication facilities, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy.

For the avoidance of doubt, Force Majeure shall not include (a) financial distress nor the inability of either party to make a profit or avoid a financial loss, (b) changes in market prices or conditions, or (c) a party’s financial inability to perform its obligations hereunder.

In the event that a force majeure applies, the customer will be bound by the supplier’s terms and conditions.

Special Requirements:

Please liaise with your consultant or, for online bookings, call 02 9823 0011, regarding any special requirements you may have for your travel arrangements such as special meal and seating requests, room type or disabled access.

Travel Documents:

Travel documents include (without limitation) airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider.  Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees.  Travel documents cannot be transferred to another person to use.  All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled.  Please review your travel documentation carefully and advise us immediately of any errors in names, dates or timings. If you have booked with a consultant, it is your responsibility to collect all travel documents from us prior to travel. As a general rule your travel documents will be available for collection 2 weeks prior to departure, however this will depend on your individual arrangements. Please contact your consultant to confirm when your travel documents are ready for collection.  If you have booked online, you should print out and retain your travel documents as provided to you by the website (or in a follow up email we send you).

Schedule Changes:

We recommend that you contact the airline to confirm your scheduled departure time 24 hours prior to your flight.

Frequent Flyer:

When booking with one of our consultants, please let them know your frequent flyer membership details (or other applicable loyalty program details) for inclusion in your booking. If you are booking online, please insert these details in the space provided for inclusion in your booking. Please check your frequent flyer program (or other applicable loyalty program) for the specific terms of your membership. We cannot guarantee that the supplier will credit you with points for your booking.

Privacy Policy:

We are committed to protecting your personal information and agree to handle your personal information in accordance with our Privacy Policy, which is available online at https://www.adriatictours.com.au/privacy-policy/ or in store.  By providing personal information to us, you agree that our Privacy Policy will apply to how we handle your personal information and you consent to us collecting, using and disclosing your personal information as detailed in our Privacy Policy.  In particular, you agree that in certain circumstances (such as where you request us to book international travel for you), we are permitted to disclose your personal information to overseas recipients.  Such recipients may include the overseas travel service providers (e.g. airlines, accommodation or tour providers) with whom you make a booking.  These travel service providers will in most cases receive your personal information in the country in which they will provide the services to you or in which their business is based.  We may also disclose your personal information to our overseas related entities and to service providers who perform services for us within and outside of Australia.  Generally, we will only disclose your personal information to these persons in connection with facilitation of your travel booking and/or to enable the performance of administrative and technical services by them on our behalf. Where we disclose your personal information to any person (including any overseas recipients), you agree that we will not be required to ensure that person’s compliance with Australian privacy laws or otherwise be accountable for how they handle your personal information. When used above, “disclose” includes to transfer, share, send, or otherwise make available or accessible to another person or entity.

Monies Received:

All monies paid by you to us is held in a Trust account and then paid out to the travel service providers. We pre pay all travel services and do not hold onto any monies paid for travel services.

Governing Law:

If any dispute arises between you and us, the laws of Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Australia, and waive any right that you may have to object to an action being brought in those courts.

YOUR OBLIGATIONS AND WARRANTIES

You warrant to us that:

(a) you are at least 18 years old and have the power and authority to enter into a binding contract with us and with the Third Party Travel Providers of the Travel Products that you acquire;

(b) the information you provide us about yourself is true, accurate, current and complete (apart from any optional items) as required by any registration process; and

(c) you will maintain and promptly update this information to keep it true, accurate and complete.

(d) You have read our terms and conditions.

(e) You have read the terms and conditions of the third party suppliers that make up your trip and agree to be bound by these.

(f) You are responsible for checking the accuracy of all documents provided to you.

(g) You are responsible for contacting the airline at least seventy-two (72) hours prior to travel.

(h) You warrant and acknowledge that you have accessed the Smarttraveller website for any specific enquiries in relation to your intended destination

(i) Passport / visa and other required identification documents are your responsibility.

(j) You warrant to us that you have considered acquiring comprehensive travel insurance and we are not responsible for any failure by you to acquire adequate insurance cover.

(k) You warrant to us that you will use the Booking & Advisory Services in accordance with these terms and conditions and you will not use the Booking & Advisory Services in any way to breach any laws or defame anyone.

Product Descriptions

Descriptions on this website are based on current information provided by hotels and suppliers. Any facilities shown as included are subject to change by the supplier at any time. The standard of accommodation and services are based on various factors and are generally accepted as indicative of a certain rating, however, we are not liable for the standard or rating of that accommodation or service. Hotel ratings are those suggested by industry local authorities or our representative and may vary from Tourist Office ratings.

Last-Minute Bookings (within 21 days of departure) and Clients that require an personalised itinerary (a immediate $50 deposit per booking for accommodation requests*)

In requesting a last minute booking, we may be required to work weekends and evenings and make international calls to ensure we can secure your booking as soon as possible, we will be required to request a $50 deposit at the time of your request, this is to ensure you request is legitimate and the booking will be fulfilled. Unfortunately, we have found in the past that a number of customers would take information of the hotels or apartments that has been booked for them and book directly. As we are a travel agency, not a government-run tourist board, our income is based on the commission we receive for bookings made through our company.

As Croatian Specialists we enjoy helping our clients and taking the time to plan and create an amazing itinerary for you. As we are specialists we also go beyond planning you itinerary to give you advice on where to go, where to eat, what to see and how long you might like to stay in each area based on your specific interests. We are always open to researching other things our clients may want to include in their holiday and we really enjoy what we do. We learn something new from every client and we absolutely love helping you plan your visit to our beautiful Croatia! However, in an effort to limit the amount of time we spent dealing with clients who then chose not to book through us, we have established a policy for a small immediate deposit so we know that your request is genuine. If we cannot find suitable accommodation based on your stated requirements, we will refund the $50 in full. We hope you understand as we’re sure that you, too, wish to be paid for the work that you do.

To our genuine clients based in areas other than Australia, we hope that you too understand that we require a small up front deposit of $50 to ensure your booking is genuine and that our information and hard work is not being used for personal gain by going elsewhere. We have clients from regions such as New Zealand, Canada, the US, the UK and many parts of Europe and we really enjoy working with overseas clients who genuinely want to use our services.

All bookings made 21 days or less before the first date of the first segment or made by overseas clients require an immediate deposit of $50 per booking in order for the request to be generated and payment in full must be made within 2 business days of confirmation, this is due to the fact that we cannot in good faith ask the supplier to hold the reservations if you do not pay us. The $50 generation fee will be deducted from the final payment when you finalise your booking. If the products you request are not available and we cannot offer you a similar product, we will refund your $50. The $50 generation fee will not be refunded if you choose not to finalise the booking for any reason other than non-availability of your requested products; or, if you just change your mind.

Bookings made 7 days or less before the first date of the first segment require, in addition to the above, payment in full immediately and may also incur an additional $50 booking fee in addition to the immediate deposit. This booking fee is in addition to your initial booking fee and is not deducted from the total upon final payment. Certain products may incur late booking fees more than 7 days before departure or may incur a higher fee. This will be advised at the time your booking is made.

Prices (all displayed in AUD$)

All prices are subject to change without notice. “From” prices quoted are the lowest available as per industry standard, usually adult twin-share, per person for tours and cruises, or per room per night, based on twin-share for accommodation. Experience Croatia & More’ prices are usually inclusive of Breakfast for Hotel Accommodation, exclusive of breakfast for Apartment Accommodation and usually Inclusive of Half Board Basis for Tours and Cruises, although please refer to itinerary and voucher for confirmation of which meals are inclusive and are available for the specified travel dates only. “From” prices quoted do not include credit card merchant fee charges put out by the bank as these may vary depending on the payment method chosen. All prices are displayed in AUD$. Prices are inclusive of taxes and charges that apply, but they do not include any fees that may be imposed directly by third parties. If we have to change any part of your booking for reasons beyond our control, eg, if a hotelier overbooks hotel accommodation, we will notify you as soon as possible.

Single supplements apply to most products for solo travellers, though we do endeavour to keep those as low as possible by not adding commission. We believe that if you require single supplement that you should not be penalised just because you’re travelling on your own, so we do the best we can to keep your costs reasonable.

Consumer Claims

In the unlikely event you might experience a problem, you should immediately contact the company responsible for the provision of that service (transfer/hotel/tour etc) whose phone number will be printed on your voucher. If you are not satisfied with their response and should you wish to make a claim, your claim should be made in writing to us or to the Travel Agent who made your booking no later than 30 days after the event. Experience Croatia & More cannot be held responsible for delays or rejection of claims by principals if your claim is not made promptly.

Unused Services

Experience Croatia & More does not authorise the employees of any overseas supplier to promise refunds to clients.

Extra Service
Experience Croatia & More and associated representatives overseas will not accept responsibility nor approve requests to pay for additional charges for extra services requested or made by clients and not included in the basic prices stated on this website. It is your responsibility to settle these charges, if any, before departure including parking fines or parking fees incurred when a rental vehicle is used, or any mini bar used or additional meals requested.

Prices and Itinerary Changes

(1) Prices are based on fluctuating currency exchange rates and are therefore an indication only. They are quoted in Australian dollar, inclusive of the European VAT and are exclusive of GST unless otherwise indicated.

Every endeavour will be made to advise you of any changes after you book.

(4) The prices quoted by Experience Croatia & More are subject to change without notice in the event of unforeseen circumstances such as fluctuation in exchange rates and/or increases in land and airfare costs, airport charges or government taxes. No surcharges in respect of cost or currency deterioration will be made once full payment for your arrangements has been received. This guarantee does not apply to any taxes, charges or levies imposed by any government or their agencies or to errors or omissions. In exchange for these guarantees, no refund will be made if costs are reduced. The entire range of products featured is offered at the selling prices shown on each page but prices printed do not imply that similar product may or may not be available at a lower price if obtained direct. However, payments sent overseas by travellers are excluded from the protection provided by Travel Agent Licensing and membership of the Travel Compensation Fund. Itineraries are subject to alteration if airline schedules are amended, a tour is cancelled by the operator for any reason, or other conditions require it. If, in the unlikely event that we have to cancel your booking because of insufficient numbers booked or because of events outside our control we will, if we are able to, offer you an alternative tour or arrangements of a similar standard. If the alternative is not suitable for you we will endeavour to refund in full any monies already paid to us for that particular tour or arrangement once refunded to us by the supplier/provider.

Hotel Information

Experience Croatia & More makes every effort to ensure accuracy in hotel information and descriptions, but we are also reliant on the suppliers and hotels giving us accurate data. Since hotels are constantly changing facilities and services, we cannot be liable for any errors or omissions herein or for any disruption caused by hotel or apartment renovations. If any feature is of critical importance to your holiday, it is the passenger’s responsibility to ask Experience Croatia & More to check whether such features will be available at the time of occupancy at the given hotel.

Changes of Hotels

If for any reason the hotel(s) nominated herein is/are unavailable, an alternative will be sought/offered. If, after confirmation, the hotel becomes unavailable, you will be assigned to a hotel of similar standard.

Responsibilities

Blazenka’s Travel Pty Ltd trading as Experience Croatia & More (A.B.N. 44 079 496 263) itself or through entities that are related or affiliated to it (all of whom are included in the expressions “Experience Croatia & More”, or the “Operator” on our website) We act as an agent only. We sell various travel related products on behalf of numerous transport, accommodation and other service providers, such as airlines, coach, rail and cruise line operators. Our obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made on your behalf subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse for travel services is against the specific provider and not us. If for any reason (excluding fault by us) any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with us.

Experience Croatia & More agrees to make the reservations with the principals offering the described services on the terms and conditions set out on this website. All tickets or vouchers issued by Experience Croatia & More (collectively “vouchers”) issued can only be used for the what is specified on the voucher only and cannot be exchanged for anything else.

Experience Croatia & More is responsible only for the services it provides and it accepts no responsibility for any loss or injury to persons or property caused by any act or omission, whether negligent or otherwise, on the part of any principal providing any services to any person taking advantage thereof, including but not limited to any loss or damage in respect of luggage or other property or inconvenience in respect of the handling thereof nor for any dissatisfaction with the properties or services provided by the principals.

Experience Croatia & More is not liable for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by events which are beyond the control of Experience Croatia & More or are not preventable including, without limitation, the acts or omissions of any person taking advantage of the services, dangers incident to the air or sea, delays, change of or alteration in any aircraft, itinerary, schedule or other travel service, illness, injury, strikes, war whether declared or not, failure of equipment, civil disturbance, medical or customs regulations, quarantines, floods, severe weather, acts of God, acts of government or other authority de jure or de facto or other disturbance of any nature, thefts, pilferage, improper or insufficient passport, visa or other documentation or anything else that interferes with, alters or adds to the cost of the services requested or booked.

The foregoing exclusions of liability are subject to all Australian and State laws, such as the Trade Practices Act and Fair Trading legislation which prohibits the exclusion of certain liability, but remain effective to the full extent permitted by such laws. Experience Croatia & More will take due care to ensure the services provided by the principals are as described on this website, but accepts liability for and only to the extent that loss or damage results directly from its own negligence or that of its employees. The making of a booking constitutes acceptance by all persons taking advantage of the services described on this website that the terms and conditions contained on this website constitute the entire agreement between them and Experience Croatia & More and that the agreement only be varied by an officer of Experience Croatia & More in writing.

Some errors may have occurred during the development of the website, we endeavour to correct them as soon as noted. However, Adriatic Adventures, its affiliates and suppliers will not be responsible for any damages caused by such errors and omissions.
